The difference between medical and recreational marijuana laws

With the cannabis legalization efforts taking place across the US, one can often hear the terms “medical” and “recreational” associated with cannabis. To a misinformed individual, cannabis may still feel associative with illicit activities. However, with more and more evidence showing that marijuana helps in various chronic medical conditions, it’s time to shed some light on the subject.

But before we tackle the legal differences between medical and recreational cannabis, let’s mention their differences beforehand because cannabis product labels might do more harm than good. For instance, classifying cannabis products as recreational or medicinal can sometimes result in government and regulatory attention shifting towards recreational use, which is much more profitable. Consequently, this can result in medicinal users being left behind.

 

Medical vs. recreational marijuana

Both medical and recreational marijuana are basically the same plant. However, when people discuss medical marijuana, they refer to the use of the entire plant, or it’s active components, to alleviate symptoms of medical conditions or diseases. And though it may sound like a novelty or some newfound miracle discovery, the first records of medical-use cannabis come from China, dating as far back as 2737 BC. Marijuana Delivery is something that is more of a recent trend.

It was later brought to Europe, and from there to North America sometime in the 1800s, where it was widely used as a medicine up until the 1930s. Luckily, with the current legalization efforts backed up by many scientific studies, medical cannabis once again found its rightful place on health store shelves. And for good reasons.

The plant contains more than 100 different components that have different effects on the body, most notably the high-inducing THC and a non-psychoactive ingredient, CBD. Though both have exceptional medical value, CBD is more widely used in medicinal applications. With that in mind, any cannabis prescribed and taken under medical jurisdiction usually has higher CBD content than its recreational counterpart.

Recreational cannabis is basically the same plant used without a doctor’s prescription or medical justification. This type of cannabis has a higher THC content than its medical counterpart and has significantly greater high-inducing properties. However, higher levels of THC can be found in medical cannabis as well.

Manufacturers of cannabis-infused products are legally obliged to state accurate levels of THC in their products. However, the cannabis industry, though legal in certain states, is still highly unregulated. And without the state-level body to regulate the industry, some manufacturers list inaccurate THC levels on their product label. This may cause legal issues for the end-user of medical marijuana products, most notably during workplace drug testing.

 

Medical and recreational use laws

In the 1930s, the Federal Bureau of Narcotics criminalized the possession and any use of cannabis, and an outright prohibition began. During the 1970s, cannabis was classified as a Schedule 1 drug, deemed to have a high potential for abuse, and no accepted medical use.

Today, the majority of US states legalized medical marijuana, despite it being illegal on a federal level. At the moment of writing, medical cannabis is legalized (with doctor’s prescription) in 33 states, while fourteen other states have laws that limit THC content but allow access to products rich in CBD.

Recreational use of cannabis is permitted in eleven states, including Alaska, California, Colorado, Illinois, Massachusetts, Maine, Washington, Nevada, Vermont, Oregon, and Michigan. The District of Columbia, the Northern Mariana Islands, and Guam have also permitted recreational use.

Despite being federally illegal, there are marijuana for sale online, medical cannabis users are protected from federal prosecution by several legal acts, laws, and amendments. Unfortunately, cannabis legality (and enforcement) varies by state, and while medical cannabis users enjoy protection from federal prosecution, they’re not exempt from workplace drug testing. This is especially worrying, knowing that medical cannabis might also trigger drug tests for THC.

We contacted our friends from MedSignals.com and asked them to shed some light on the matter, and here’s what they said:

“Due to the low THC content of medical marijuana, medical use shouldn’t be detectable during workplace drug tests. Unfortunately, due to overly loose industry regulations, higher levels of THC might be present in medical cannabis products, which may trigger drug tests. This is particularly problematic for medical cannabis users since they aren’t exempt from testing based on their medical condition requiring them to use cannabis.”

In other words, individuals that fail a mandatory drug test due to their medical use of cannabis can’t justify the results with a doctor’s note. And since cannabis is federally illegal, and drug-free workplace policies are passed by the US Supreme Court (federal court), all instances are resolved on a federal level. All positive drug test results, whether medical or recreational, are treated as a violation of drug-free workplace policies and must result in termination of employment.

 

Final Thoughts

Despite being illegal on a federal level, some form of cannabis use is legalized in 47 states, with only three prohibiting its use entirely. Unfortunately, the differences between federal and state laws and outdated laws and regulations make things difficult for medical marijuana users.

Unlike individuals with alcohol abuse issues, medical cannabis users aren’t protected by the Americans with Disabilities Act. As such, they’re still found guilty for violating a drug-free workplace policy, imposed by their employer, for using cannabis to alleviate symptoms of their medical condition. However, with the ongoing cannabis legalization efforts, we hope this, too, will change.

Ghanaians and resident foreigners no longer require full COVID-19 vaccination before entering the country

The Ghana Health Service (GHS) has announced some changes to the guidelines for Ghanaians entering the country through the Kotoka International Airport (KIA).

Per the earlier modification implemented during the yuletide last year, persons aged 18 years and above, arriving in Ghana from December 12, 2021, were to provide proof of full vaccination.

But addressing pressmen on Wednesday, Director-General of GHS, Dr. Patrick Kumah-Aboagye explained that the directive has been reviewed to make it more lenient.

Now, unvaccinated or partially vaccinated Ghanaians and resident foreigners have been “exempted from the requirement of full vaccination before traveling to Ghana.”

He made this comment at the Ministry of Information where the press conference was held.

GHS revises Covid-19 travel guidelines for Ghanaian travelers at KIA
Dr. Kumah-Aboagye explained that persons who will be affected by the review are expected to take the vaccination on arrival at KIA.

In this regard, persons who refuse to accept the jab will be forced to go on mandatory 7-day quarantine at their own cost.

This, according to the GHS Director-General, forms part of measures to reduce the effects of the fourth wave of the pandemic in the country.

From July 1, only your National ID card will be accepted for banking and financial transactions in Ghana

From 1st July, 2022, the Ghana Card will be the only identification for banking or financial transactions, the Bank of Ghana has disclosed.

This is in furtherance of its objective of ensuring the safety of the financial system. In a statement, the Central Bank said this is pursuant to Regulation 7 of the National Identity Register, 2012 (L.I. 2111).

In this regard, the BoG is directing Banks, Specialised Deposit-Taking Institutions, Non-Deposit-Taking Financial Institutions; Payment Service Providers and Dedicated Electronic Money Issuers as well as Forex Bureaus and Credit Reference Bureaus to start using the Ghana for identification from beginning of July, 2022.

“In line with this Notice, Section 30 of the Anti-Money Laundering Act, 2020 (Act 1044) and Regulation 12 of the Anti-Money Laundering Regulations, 2011 (L.I. 1987), all financial institutions shall take steps to update customer records with the Ghana Card.”

Furthermore, “customers of Bank of Ghana regulated financial institutions are therefore advised to update their records with their respective financial institutions with the Ghana Card in line with this Notice.”

The Central Bank said for Known Your Customer purposes, the National Identification Authority verification transaction platform will be integrated into the Bank of Ghana’s financial monitoring platform.

This is to ensure that all financial transactions performed within the ecosystem are linked to one identity and information, and unique codes for the transactions shared with the BoG to facilitate the identification of initiators/beneficiaries for track and trace purposes.

It will include but not limited to transactions b banks; non-bank Financial Institutions and Mobile Money Operators (MMOs).

George Boateng: Ghanaian Computer Scientist Launches Smartphone-Based Coding App, ‘SuaCode’

In ensuring that learning how to code becomes much easier and fun, George Jojo Boateng, a Ghanaian computer scientist and social entrepreneur created SuaCode, a smartphone-based coding app. The app was launched on Google Play Store in January 2022, and has had some great reviews so far.

Boateng started SuaCode in 2017 as a graduate student at Dartmouth College, during Project iSWEST, an annual innovation bootcamp for high school students in Ghana organised by his education non-profit Nsesa Foundation. From 2018 to 2020, with four pilots, SuaCode had over 3,000 applicants from 69 countries, accepted over 1,000 students, with a 62% completion rate and alumni getting internships, jobs and studying computer science and engineering in top universities, including, Yale, Columbia, Dartmouth, and MIT.

In 2021, Boateng and cofounder Victor Kumbol improved on the idea and launched the startup, SuaCode.ai to transform SuaCode into a smartphone app, with the aim of teaching millions across Africa to code using smartphones and an AI teaching assistant, Kwame.

The SuaCode app enables users to learn how to code on their phone at anyplace, at anytime in a community of learners across the globe. Through Kwame, a bilingual AI Teaching assistant that Boateng built, the app presents lessons in English and French along with fun and hands-on coding exercises, quizzes and assignments. It also provides quick and accurate answers to students’ coding questions.

The app’s Automated Grading Software, AutoGrad, grades users’ assignments while checking for plagiarism and providing individualized feedback; and users receive a certificate of completion when they complete courses.

For his work on SuaCode.ai, George Boateng has been recognized by the MIT Technology Review as a Pioneer in the 2021 list of 35 Innovators under 35.

Currently pursuing his PhD in Applied Machine Learning at ETH Zurich, Switzerland, Boateng is also the President and co-founder of Nsesa Foundation, which aims at achieving the vision of creating an “Innovation Revolution” in Ghana. He was also, recently, appointed as a Visiting Researcher at the University of Cambridge’s Computer Science department, where he will be exploring collaborations on AI-powered mobile heath research.

Single Kiasi (Singleish), the new Kenyan Showmax Original, is now streaming, with new episodes releasing every Thursday. The show will also be available to Kenyans in the UK, France and 31 other countries in the diaspora.

What does the pursuit for the one look like for 30-something women in Nairobi?

Sintamei (Gathoni Mutua) is trying to start a family with her loving husband Kevin (Lucarelli Onyango) while also building her career as a corporate lawyer.

Rebecca (Faith Kibathi) is all about motherhood, being a housewife and staying loyal to her “husband” Eric (Michael Munyoki), even though he doesn’t have a shilling to his name.

And Mariah (Minne Kariuki) is all about expensive gifts and traveling to the best destinations her rich sponsor’s money can buy, while chasing the next social media high and sharing slay queen dating tips with her many followers. “Paris was amazing. If your guy takes you to Dubai, please dump him,” she tells her fans while on a private jet from her vacation in France.

When we catch up with them in the first episode of Single Kiasi, they seem to have their lives and their romantic relationships under control. But dating in Nairobi can be hectic, and it doesn’t take long before the men of Single Kiasi prove the popular saying in the city’s dating scene: “Men will embarrass you unprovoked,” as reiterated by Mariah.

In the course of the 13 episodes, Single Kiasi follows Sintamei, Rebecca and Mariah as they go through the ups and downs of love and dating in Nairobi while also reminding us that, at the end of the day, friendship is the most powerful relationship they can have.

Single Kiasi is the second Showmax Original series in Kenya after the Kalasha-winning Crime and Justice.

The show is adapted from the popular South African series Unmarried, which already has successful adaptations in Nigeria (Unmarried Nigeria) and Ghana (To Have and To Have Hold).

“It’s a universal story of womanhood, love and friendship,” says producer and director Grace Kahaki. “But we had to make some changes here and there for the story to fit to who we are as Kenyans.”

For instance, Single Kiasi incorporates a Kikuyu traditional marriage ceremony (nguracio) in place of a church wedding.

“In the South African version, one of the leading women has an affair with a security guard but we felt that this wasn’t authentic to the Kenyan setting so changed the guard to an intern, which is more reflective of what happens here,” Kahaki says.

Single Kiasi tackles important issues that Kenyan women go through, such as sexism in the workplace like when Sintamei is passed over for a promotion that she clearly deserves, sexual assault like in the case of Mariah who is forced to confront a past she’d rather forget, and women (and mothers) finding their own identities outside of what society expects of them like Rebecca getting to relive her youth which she missed out on by marrying too young.

“This show aims to look at women through our three main characters and allow them to choose what label they want to attach to themselves, be it single, married, wife, career woman, mother, etc,” Kahaki says.

Kahaki co-produced and co-directed Single Kiasi alongside her Insignia Productions counterpart Philippe Bresson, and Robby Bresson (Simiyu Samurai).
