Osinachi: Court dismisses singer’s husband’s no-case submission

Justice Njideka Nwosu-Iheme of the Federal Capital Territory High Court in Wuse Zone 2 has rejected the no-case submission filed by Peter Nwachukwu, the husband of the late gospel singer, Osinachi Nwachukwu.

The court held that the prosecution has established a case against the defendant.

The Federal Government had filed a 23-count charge against Nwachukwu in connection with Osinachi’s death. After pleading not guilty, the judge ordered the defendant’s remand at the Kuje correctional facility pending further proceedings.

During the trial, which ran from June 20, 2022, to March 10, 2023, the prosecution presented 17 witnesses.

Osinachi Nwachukwu, who passed away on April 8, 2022, initially faced suspicion of throat cancer as the cause of death. However, family and friends alleged her death was linked to assault by her husband, leading to his arrest.

An autopsy from the National Hospital in Abuja indicated that there was no evidence of violence on the deceased. The report listed the cause of death as organ-related issues, including cardiac tamponade, which is the primary cause, and the abnormal growth of tissue (cancer), the secondary cause.

Mr. Nwachukwu’s counsel argued that the autopsy report exonerated his client from the allegations of culpable homicide and domestic violence, urging the court to acquit him.

However, the court dismissed the no-case submission and instructed the defendant to present his defense.
